Welcome to openbxd.com. These Terms & Conditions (“Terms”) govern your access to and use of the website openbxd.com (the “Site”), operated by OpenBXD (“we,” “us,” or “our”), located at 322 E National Rd, Vandalia, OH 45377. By accessing the Site, creating an account, or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About OpenBXD

OpenBXD is a liquidation retail company. We purchase merchandise in bulk from major national retailers — including customer returns, overstock items, and shelf-pulls — then individually inspect, grade, photograph, and resell each item at a significant discount. Products are sold online through this Site and at our physical retail location in Vandalia, Ohio.

2. Eligibility

You must be at least 18 years of age to use this Site or make a purchase. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

You may create an account to access certain features of the Site, including order tracking and purchase history. When creating an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately at hey@openbxd.com if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate any account at our discretion if we believe these Terms have been violated.

4. Products and Pricing

4.1 Product Descriptions

We make every effort to accurately describe and photograph each product listed on the Site. Because our products are sourced from liquidation channels, each item is unique. Product listings include real photographs of the actual item you will receive, along with a condition grade (New in Box, Open Box, Gently Used, or Scratch & Dent). Please read the full product description and review all photos before purchasing.

4.2 Condition Grades

  • New in Box: Factory sealed, never opened. Complete with all original packaging and accessories.
  • Open Box: Packaging has been opened but the item is barely used. May have been a customer return. All parts included.
  • Gently Used: Fully functional with minor cosmetic wear. Great value.
  • Scratch & Dent: Cosmetic damage but fully functional. Deepest discounts for items that work perfectly.

4.3 Pricing

All prices are listed in U.S. dollars (USD) and are subject to change without notice. Prices displayed on the Site include any applicable discounts. Sales tax will be calculated and added at checkout based on your shipping address in accordance with applicable state and local tax laws. We reserve the right to correct pricing errors. If an item is listed at an incorrect price, we will notify you and give you the option to cancel the order.

4.4 Product Availability

Because we sell unique, one-of-a-kind items sourced from liquidation, inventory is limited. Items are available on a first-come, first-served basis. We cannot guarantee that any item will remain in stock. If an item becomes unavailable after you place an order, we will notify you promptly and issue a full refund.

5. Orders and Payment

5.1 Placing an Order

When you place an order through the Site, you are making an offer to purchase the selected product(s). All orders are subject to acceptance by us. We may decline or cancel any order for any reason, including but not limited to product unavailability, pricing errors, or suspected fraud.

5.2 Payment

We accept payments through Stripe, which supports major credit and debit cards. All payment processing is handled securely by Stripe, which is PCI DSS Level 1 certified. We do not store your full payment card information on our servers. By submitting your payment information, you authorize us to charge the total order amount, including applicable taxes and shipping fees. For in-store purchases, we also accept cash.

5.3 Order Confirmation

After placing an order, you will receive an email confirmation with your order details. This confirmation does not constitute acceptance of your order. Your order is accepted when the item(s) are shipped, and you receive a shipping confirmation email.

6. Shipping and Delivery

  • Processing Time: Orders are processed within 1–2 business days of payment confirmation.
  • Shipping Methods: We ship via USPS, UPS, and FedEx. Shipping rates are calculated at checkout based on package weight, dimensions, and destination.
  • Delivery Timeframe: Standard delivery typically takes 3–7 business days after shipment, depending on your location and the carrier used.
  • Shipping Area: We currently ship to addresses within the contiguous United States.
  • Local Pickup: Free local pickup is available at our store at 322 E National Rd, Vandalia, OH 45377 during business hours.
  • Risk of Loss: Title and risk of loss for purchased items pass to you upon delivery to the carrier.

We are not responsible for shipping delays caused by carriers, weather events, or other circumstances beyond our control. If your package is lost or damaged in transit, please contact us within 7 days of the expected delivery date.

7. Returns and Refunds

Please refer to our Returns & Refunds Policy for complete details on our return process, eligibility, and timelines. Key points include:

  • Returns must be initiated within 30 days of delivery.
  • Items must be in the same condition as received, with all original packaging and accessories.
  • Return shipping costs are the responsibility of the buyer unless the item was received damaged, defective, or materially different from the listing.
  • Refunds will be issued to the original payment method within 5–10 business days after we receive and inspect the returned item.

8. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, images, product photographs, page layouts, and software — is the property of OpenBXD or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not:

  • Copy, reproduce, distribute, or publicly display any content from the Site without our prior written consent.
  • Use our trademarks, trade names, or branding in any manner that suggests endorsement or affiliation without authorization.
  • Use automated tools (bots, scrapers, spiders) to access, index, or collect content from the Site.
  • Modify, create derivative works from, or reverse-engineer any part of the Site.

Product images on our Site are original photographs taken by OpenBXD staff. Unauthorized use of our product images is strictly prohibited.

9. Prohibited Conduct

When using the Site, you agree not to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Submit false, misleading, or fraudulent information, including fraudulent orders or payment information.
  • Interfere with or disrupt the Site, servers, or networks connected to the Site.
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems.
  • Use the Site for any commercial purpose other than purchasing products for personal use, unless specifically authorized by us.
  • Engage in any activity that could damage, disable, or impair the Site’s functionality.
  • Harass, threaten, or abuse other users or our staff.

10. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Because our products are sourced from liquidation channels, we make no warranty that any product will be free from cosmetic imperfections, prior use, or missing accessories beyond what is described in the product listing. Each product listing describes the specific condition of that individual item. Please review the condition grade, description, and photographs before purchasing.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPENBXD AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless OpenBXD, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the Site.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at hey@openbxd.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any issue within 30 days.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any legal action arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Montgomery County, Ohio, and you consent to the personal jurisdiction of such courts.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on the Site with a revised “Last Updated” date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically. For material changes, we will make reasonable efforts to notify registered users via email.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and OpenBXD regarding your use of the Site and supersede all prior agreements and understandings, whether written or oral.
